DECISION & ORDER ON MOTION

Motion by the appellant to extend the time to make a motion for leave to reargue an appeal from an order of the Supreme Court, Nassau County, entered November 7, 2005, which was determined by decision and order of this court dated December 19, 2006, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this court, and, upon extending the time to make the motion, to grant that relief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that the branch of the motion which is to extend the time to make a motion for leave to reargue or, in the alternative, for leave to appeal to the Court of Appeals is granted; and it is further,

ORDERED that the branch of the motion which is for leave to reargue or, in the alternative, for leave to appeal to the Court of Appeals is denied.
