DECISION & ORDER ON MOTION

Motion by the appellants on an appeal from an order and judgment (one paper) of the Supreme Court, Nassau County, entered August 25, 2006, to enjoin the respondents from commencing, inter alia, any substantial work on the subject project and for a preference in the calendaring of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to enjoin the respondents from commencing, inter alia, any substantial work on the subject project is denied; and it is further,

ORDERED that the branch of the motion which is for a preference in the calendaring of the appeal is granted, and the appeal will be calendared expeditiously.
