DECISION & ORDER ON MOTION

Motion by Barry A. Weinstein, Esq., to be substituted as retained counsel, in place of assigned counsel, to prosecute an appeal from a judgment of the Supreme Court, Queens County, rendered November 30, 2004, and to continue the appellant's poor person status. The appellant's motion to dispense with printing and for assignment of counsel was granted on March 22, 2005, and the following named attorney was assigned as counsel to prosecute the appeal:
