It is Ordered that the motion is granted to the extent of re-instating the stay of the execution of the warrant of eviction pending the determination of the appeal. The appeal is presently noticed for the May 2007 term. In the event the appellant fails to pay accruing use and occupancy on each subsequent rental due date, the petitioner may move on five days' notice for an order vacating the stay.
