On the court's own motion, it is

ORDERED that its decision and order on motion dated December 15, 2005, in the above-entitled matter is recalled and vacated, and the following decision and order on motion is substituted therefor:

Motion by Samuel Sloan, inter alia, to recall and vacate two decisions and orders on motion of this court both dated November 17, 2005, which dismissed appeals from two orders of the Family Court Queens County, both dated October 6, 2005, on the ground that the orders were not appealable as of right, and to grant leave to appeal from those orders.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
