DECISION & ORDER ON MOTION

Motion by the respondent to reopen the hearing before the Special Referee to allow additional testimony and evidence or, for leave to reargue the opinion and order of this court dated October 24, 2006, and upon reargument, modifying the discipline imposed or, in the alternative, for leave to appeal to the Court of Appeals. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on May 19, 1993. By opinion and order of this court dated October 24, 2006, he was disbarred based upon six charges of professional misconduct.

Upon the papers submitted in support of the motion and the papers submitted in opposition thereto, it is

ORDERED that the motion is denied in its entirety.
