(Ind. Nos. 05-00661, 05-00758)

DECISION & ORDER ON MOTION

Motion by counsel assigned to prosecute appeals from two judgments of the County Court, Westchester County, both rendered January 31, 2006, to be relieved. By order to show cause dated February 15, 2007, the appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeals on the ground that the appeals had been abandoned, and the motion to be relieved was held in abeyance in the interim. Application by the appellant to withdraw the appeals.

Upon the motion and the papers filed in relation thereto, the order to show cause, and the application, it is

ORDERED that the application is granted and the appeals are deemed withdrawn; and it is further,

ORDERED that the motion by assigned counsel and the order to show cause to dismiss the appeals are denied as academic.
