It is ordered that the motion is granted to the extent of permitting the defendant to file an untimely notice of appeal within 30 days of the date of this order. That branch of the motion seeking permission to appeal as a poor person and the assignment of counsel is denied without prejudice to renew upon completion of an affidavit pursuant to CPLR § 1101. The Clerk's office is directed to provide an affidavit form to the defendant.
