Application by the appellant on an appeal from an order of the Supreme Court, Queens County, dated November 30, 2005, to substitute Elizabeth Galati, administrator of the estate of Benito Galati, for the deceased defendant Benito Galati.
Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is
ORDERED that the application is granted and Elizabeth Galati, administrator of the estate of Benito Galati, is substituted for the deceased defendant Benito Galati, and the caption has been amended accordingly.
