DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from an order of the Family Court, Dutchess County, dated March 27, 2006, for the court to take judicial notice of "Blank Official Financial Disclosure Affidavit, Family Court Official Form 4-17".

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that on the court's own motion, the decision and order on motion of this court dated March 1, 2007, is recalled and vacated, and the appellant's prior motion to resettle the record and to enlarge the time to perfect the appeal is denied as academic as the appellant has perfected the appeal; and it is further,

ORDERED that the motion for the court to take judicial notice of "Blank Official Financial Disclosure Affidavit, Family Court Official Form 4-17" is granted.
