| DECISION & ORDER ON MOTION |
On the court's own motion, it is
ORDERED that its decision and order on motion dated December 7, 2006, in the above-entitled case is amended by deleting the second and third decretal paragraphs thereof and substituting therefor the following decretal paragraphs:
ORDERED that the motion to strike the appellant's supplemental pro se brief is granted and the Clerk of this court shall advise the appellant of the date by which the replacement supplemental brief is to be filed; and it is further,
ORDERED that the respondent shall serve and file its brief in response to the brief of the appellant's assigned counsel and the appellant's supplemental pro se brief within sixty days of service upon it of the appellant's replacement supplemental brief, and the respondent may file one responsive brief if it be so advised.
