DECISION

On the court's own motion, motion by landlord-respondent returnable February 16, 2007, and motion by tenant-appellant returnable February 23, 2007, are hereby consolidated for purposes of disposition.

Motion by tenant-appellant, in essence, to reinstate and continue the stay contained in the order of this court dated November 30, 2006, is granted on condition that tenant perfects the appeal by May 4, 2007.

Motion by landlord-respondent to vacate the stay contained in the order of this court dated November 30, 2007 is denied.

In the event that the above condition is not met, the court, on its own motion, may vacate the stay, or the respondent may move to vacate the stay on three days' notice.
