DECISION & ORDER ON MOTION

Motion by the appellant to recall and vacate a decision and order on motion of this court dated February 16, 2007, which dismissed an appeal from a judgment of the County Court, Nassau County, rendered June 7, 2002, pursuant to 22 NYCRR 670.8(f) as abandoned, to reinstate the appeal, and to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
