DECISION & ORDER ON MOTION

Motion by Kent V. Moston, Esq., counsel assigned to represent the appellant Darryl D. R. in a proceeding before the Family Court, Nassau County, to be relieved on an appeal from an order of the Family Court, Nassau County, dated August 10, 2006. By order to show cause dated February 27, 2007, as amended by decision and order on motion dated March 12, 2007, the parties or their attorneys were directed to show cause before this court why an order should or should not be made and entered dismissing the appeal of Darryl D. R. in the above-entitled proceeding as abandoned, and the motion by assigned counsel was held in abeyance.

Upon the order to show cause and no papers having been filed in response thereto, and upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the assigned counsel's motion is granted and assigned counsel is relieved; and it is further,

ORDERED that the order to show cause to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements.
