DECISION & ORDER ON MOTION

Appeal by the defendant, by permission, from an order of the County Court, Rockland County, dated January 28, 2003. The appeal has not been perfected. By order to show cause dated March 9, 2007, the appellant was directed to show cause before this court why an order should or should not be entered dismissing the above-entitled appeal for failure to timely perfect the same in accordance with the rules of the court (see CPL 460.70[2][c]; 22 NYCRR 670.8[f]).

Now, upon the court's own motion, and no papers having been filed in response thereto, it is

ORDERED that the appeal is dismissed (see 22 NYCRR 670.8[f]).
