v Willie Williams, appellant.

(Ind. No. 03-00870)

DECISION & ORDER ON APPLICATION

Appeal by Willie Williams from a judgment of the County Court, Westchester County, rendered June 25, 2004. By letter dated February 6, 2007, Mark L. Freyberg, the appellant's retained counsel, advised the court that he had been discharged. By decision and order on motion dated February 14, 2007, the court directed the appellant to either (1) retain new counsel to perfect the appeal and advise the court of the name and address of retained counsel, or (2) perfect the appeal or seek an enlargement of time to perfect the appeal. Application by the appellant, in effect, to recall and vacate the decision and order on motion dated February 14, 2007, on the ground that he has rehired his former attorney and that attorney will perfect the appeal.

Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is

ORDERED that the decision and order on motion of this court dated February 14, 2007, is recalled and vacated.

MILLER, J.P., SPOLZINO, GOLDSTEIN and McCARTHY, JJ., concur.
