Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Orange County, dated August 16, 2006, on the ground that the order is not appealable as of right and the appeal should have been taken from an order and judgment (one paper) of the same court dated June 6, 2006.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, and the appeal is dismissed, without costs or disbursements.
