DECISION & ORDER ON MOTION

Motion by the American Planning Association and the Association of Towns of the State of New York for leave to file an amici curiae brief on an appeal and cross appeal from a judgment of the Supreme Court, Suffolk County, entered April 28, 2006. Separate motion by John D. Echeverria, an attorney in good standing in the District of Columbia, to be admitted pro hac vice to represent the amici curiae.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the motions are granted; and it is further,

ORDERED that the amici curiae brief must be served on the parties, and nine copies filed in this court on or before May 14, 2007; and it is further,

ORDERED that no oral argument by the amici curiae shall be permitted; and it is further,

ORDERED that the parties, if they be so advised, may file reply briefs to the amici curiae brief within 10 days after service upon them of the amici curiae brief.
