| DECISION & ORDER ON MOTION |
Appeal by Jane Quatrale from an order of the Supreme Court, Suffolk County, entered February 2, 2007. Motion by Jane Quatrale for leave to appeal to this court from an order of the same court dated April 24, 2007, and to stay the trial in the above-entitled action pending hearing and determination of the appeals.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the court's own motion, the appeal from the order entered February 2, 2007, is dismissed, without costs or disbursements, on the ground that the order is not the result of a motion made on notice (see CPLR 5701[a]) and we decline to grant leave to appeal; and it is further,
ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,
ORDERED that the branch of the motion which is to stay the trial is denied as academic.
