DECISION & ORDER ON MOTION

Appeal by June N. from an order of the Family Court, Suffolk County, dated September 27, 2006. By decision and order on motion of this court dated February 13, 2007, the branch of the motion of the assigned counsel which was to be relieved was held in abeyance, and the appellant was granted leave to renew a motion for leave to prosecute the appeal as a poor person on or before April 7, 2007. The appellant failed to do so.

Now, on the court's own motion, and the papers filed in support of the motion of the assigned counsel, and no papers having been filed in opposition or relation thereto, it is

ORDERED that the branch of the motion which was to relieve the assigned counsel is granted; and it is further,

ORDERED that the appeal is dismissed, without costs or disbursements.
