It is Ordered that the motion is granted to the extent of staying the trial in this proceeding on condition that the appellant: 1- on or before May 18, 2007, deposits $64,890.oo, representing nine (9) months rent at $7,210.oo per month, with the Clerk of the Civil Court; 2- thereafter, by the tenth day of each month, deposits accruing use and occupancy with the Clerk of the Civil Court; and 3- perfects the appeal by June 20, 2007, for the September 2007 term. In the event of appellant's failure to comply with the foregoing conditions, petitioner may move on five days' notice for an order vacating the stay of the proceeding in the trial court.
