| DECISION & ORDER ON MOTION |
Motion by the appellant, in effect, to amend a decision and order of this court dated April 3, 2007, which determined an appeal from a judgment of the Supreme Court, Queens County, dated May 24, 2005, on the ground that the decision and order dated April 3, 2007, contains an error.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted and the decision and order dated April 3, 2007, is amended by deleting from the third paragraph on page 1 the following phrase: "counterclaimed for a divorce", and substituting therefor the following phrase: "counterclaimed for a judgment of separation".
