DECISION & ORDER ON MOTION

On the court's own motion, it is

ORDERED that its decision and order on motion dated May 2, 2007, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:

Motion by the respondent for leave to defend an appeal from an order of the Family Court, Westchester County, dated January 30, 2007, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that the motion is denied with leave to renew on or before May 25, 2007, upon proper papers establishing that the respondent is entitled to poor person relief, including a financial affidavit listing all sources of income and assets.
