| DECISION & ORDER ON MOTION |
Motion by the appellants-respondents on an appeal and cross appeal from an order of the Supreme Court, Suffolk County, dated December 10, 2004, and a judgment of the same court dated January 13, 2005, inter alia, to dismiss the cross appeal on the ground that the respondent-appellant has failed to pay his share of the cost of the joint record on appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that on or before May 24, 2007, the respondent-appellant shall pay the additional sum of $865 to the attorneys for the appellants-respondents to cover one half of the cost of the joint record.
