| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss a proceeding pursuant to CPLR article 78, which was transferred to this court pursuant to an order of the Supreme Court, Westchester County, entered March 20, 2006, as abandoned, or, in the alternative, to vacate a temporary restraining order contained in an order to show cause of the same court dated December 21, 2005. Application by the petitioner pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect the proceeding.
Upon the papers filed in support of the motion and the application, and the papers filed in opposition thereto, it is
ORDERED that the motion is denied, and it is further,
ORDERED that the application is granted, the petitioner's time to perfect the proceeding is enlarged until June 25, 2007, and the petitioner's record or appendix and brief must be served and filed on or before that date; and it is further,
ORDERED that no further enlargements of time shall be granted.
