DECISION & ORDER ON MOTION

Motion by the appellant to enlarge the time to make a motion for leave to reargue an appeal from a judgment of the County Court, Rockland County, rendered April 1, 2003, separate motion by the appellant for leave to reargue the appeal, and application by the appellant to hold the motion for leave to reargue in abeyance pending determination of an action commenced in the Supreme Court for a declaratory judgment. The appeal was determined by decision and order dated January 30, 2007.

Upon the papers filed in support of the motions and the application, and the papers filed in opposition to the motion for leave to reargue the appeal, it is

ORDERED that the motion to enlarge the time to make a motion for leave to reargue is granted; and it is further,

ORDERED that the motion for leave to reargue and the application are denied.
