DECISION & ORDER ON MOTION

Motion by MHC Greenwood Village NY, LLC, for leave to appeal to this court from an order of the Supreme Court, Nassau County, dated May 1, 2007, and, inter alia, to stay the effective date of Suffolk County Local Law 1534-2006.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is granted; and it is further,

ORDERED that the branch of the motion which is to stay the effective date of Suffolk County Local Law 1534-2006 is granted, and the effective date of Suffolk County Local Law 1534-2006 is stayed pending either hearing and determination of the appeal or determination of the order to show cause in the above-entitled action, returnable before the Supreme Court, Nassau County, on May 10, 2007, whichever occurs first; and it is further,

ORDERED that the motion is otherwise denied.
