DECISION & ORDER ON MOTION

Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Westchester County, dated January 5, 2007, on the ground that the appellants failed to timely serve the notice of appeal. Application by the appellants, in effect, to deem the notice of appeal timely served.

Upon the papers filed in support of the motion and the application and the papers filed in opposition thereto, it is

ORDERED that the application is granted, the notice of appeal is deemed timely served (see CPLR 5520[a]); and it is further,

ORDERED that the motion is denied.
