It is Ordered that the motion and cross-motion are consolidated for the purpose of disposition. The stay of the re-trial in this proceeding is continued until June 13, 2007. If, by said date, the appellants have paid the April, May and June use and occupancy, at the rate of $500.oo per month, to the petitioner, then the appellants may move for a further continuation of the stay. Otherwise, the stay is vacated and the re-trial of this hold-over proceeding may be restored to the Civil Court calendar. [ cal # 07-098 / March term ]
