Motion by the petitioner to stay all proceedings in an action entitled People v Prospect, pending in the County Court, Suffolk County, under Indictment No. 2011-06, pending hearing and determination of the above-entitled proceeding pursuant to CPLR article 78.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted and all proceedings in the action entitled People v Prospect, pending in the County Court, Suffolk County, under Indictment No. 2011-06, are stayed pending hearing and determination of the proceeding.
