Motion by the appellants-respondents to resettle a decision and order of this court dated February 13, 2007, determining an appeal and cross appeal from an order of the Supreme Court, Nassau County, entered December 7, 2004, and an appeal from an order of the same court dated August 25, 2005, for leave to reargue the appeals and cross appeal, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this court. Cross motion by the respondent-appellant for leave to reargue the appeals and cross appeal.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion and cross motion are denied.
