DECISION & ORDER ON MOTION

Motion by the appellant for leave to prosecute appeals from an order and an amended order of the Family Court, Queens County, dated July 18, 2006, and August 1, 2006, respectively, as a poor person and for the assignment of counsel. Cross motion by the respondent Mercy First to dismiss the appeals for failure to timely perfect same in accordance with prior orders and the rules of this court.

Upon the papers filed in support of the motion and the cross motion and the papers filed in opposition thereto, it is

ORDERED that the cross motion is granted; and it is further,

ORDERED that the appeals are dismissed, without costs or disbursements; and it is further,

ORDERED that the motion is denied as academic.
