| DECISION & ORDER ON MOTION FOR REINSTATEMENT |
Motion by the respondent Peter Brogan, for reinstatement as an attorney and counselor-at-law. By opinion and order of this court dated November 15, 1993, he was disbarred pursuant to Judiciary Law § 90 upon his resignation as an attorney and counselor-at-law, pursuant to 22 NYCRR 691.9. By decision and order on motion of this court for reinstatement dated June 10, 2005, the motion was held in abeyance and the matter was referred to the Committee on Character and Fitness to investigate and report on the respondent's current fitness to be an attorney including, but not limited to: (1) the details of the respondent's compliance with the order of disbarment, including steps taken to notify all clients, return all files, and close his practice, and the respondent's failure to previously file an affidavit of compliance; and (2) the details of the respondent's continuing legal education business. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on April 27, 1977.
Upon the report of the Committee on Character and Fitness and the exhibits annexed thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that, effective immediately, the respondent, Peter Brogan, is reinstated as an attorney and counselor-at-law and the Clerk of the Court is directed to restore the name of Peter Brogan, to the roll of attorneys and counselors-at-law.
