DECISION & ORDER ON MOTION
FOR REINSTATEMENT

Motion by the respondent, Shahriar Kashanian, for reinstatement as an attorney and counselor-at-law. By opinion and order of this court dated July 6, 1999, the respondent's resignation pursuant to 22 NYCRR 691.9 was accepted, and he was disbarred pursuant to Judiciary Law § 90 and his name was stricken from the roll of attorneys and counselors-at-law. By decision and order on motion of this court for reinstatement dated November 1, 2006, the motion was held in abeyance and the matter referred to the Committee on Character and Fitness to investigate and report on the respondent's current fitness to practice law, including but not limited to: (1)details of his compliance with this court's order of disbarment; (2)clarification of the status of his admission to practice before the United States District Court, Eastern District of New York, and whether he was disciplined by that court following his disbarment by this court; and (3) his plans for practicing law and for preventing the type of problems which arose with his practice in the past, in the event of reinstatement. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on May 1, 1985.

Upon the report of the Committee on Character and Fitness and the exhibits annexed thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that, effective immediately, the respondent, Shahriar Kashanian, is reinstated as an attorney and counselor-at-law and the Clerk of the Court is directed to restore the name of Shahriar Kashanian to the roll of attorneys and counselors-at-law.
