Motion by the petitioner in a proceeding pursuant to CPLR article 78, in effect, to stay his retrial in an action entitled People v Jeffrey, pending in the Supreme Court, Kings County, under Indictment No. 1166/05, pending hearing and determination of the proceeding.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and the retrial in the action entitled People v Jeffrey, pending in the Supreme Court, Kings County, under Indictment No. 1166/05, is stayed pending hearing and determination of the proceeding.
