DECISION & ORDER ON MOTION

Motion by Robert Nicholson, Esq., to be substituted as retained counsel, in place of assigned counsel, to prosecute an appeal from an order of the Family Court, Kings County, dated March 24, 2006. Separate motion by the appellant to substitute retained counsel for assigned counsel and to continue her status as a poor person. The appellant's motion to dispense with printing and for the assignment of counsel was granted on July 13, 2006, and the following named attorney was assigned as counsel to prosecute the appeal:

Upon the papers filed in support of the motions and no papers having been filed in opposition or relation thereto, it is

ORDERED that the motions are granted: and the following retained counsel is substituted for assigned counsel:

and it is further,

ORDERED that assigned counsel is directed to turn over all papers in the action, including any transcripts he may have obtained, to appellant's retained counsel; and it is further,

ORDERED that the branch of the motion which is to continue the appellant's status as a poor person is granted.
