| DECISION & ORDER ON MOTION |
Application by the appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal from a decision of the County Court, Suffolk County, dated November 3, 2006
Now, upon the court's own motion, it is
ORDERED that the appeal is transferred to the Appellate Term of the Supreme Court, Ninth and Tenth Judicial Districts, for determination, as the appeal is from a decision of the County Court, Suffolk County (see 22 NYCRR 730.1[d]); and it is further,
ORDERED that the application to enlarge time to perfect the appeal is denied, without prejudice to the appellant making a motion before the Appellate Term, Ninth and Tenth Judicial Districts; and it is further,
ORDERED that all further proceedings in connection with this appeal shall be conducted pursuant to the rules of the Appellate Term, Ninth and Tenth Judicial Districts.
