DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from a resentence of the County Court, Suffolk County, imposed January 16, 2007, to continue, nunc pro tunc to May 21, 2007, the stay of execution of said resentence, which was granted by a decision and order on motion of this court dated January 19, 2007, pending determination of the appeal to this court.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.

We note that the stay of execution of the resentence expired on May 21, 2007.
