DECISION & ORDER ON MOTION

Motion by the appellant, in effect, for leave to renew his prior motion to stay enforcement of an order of the Supreme Court, Orange County, dated February 5, 2007, pending hearing and determination of an appeal therefrom.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the order dated February 5, 2007, is stayed and pending hearing and determination of the appeal the appellant's attorney shall retain the sum of $182,780 in escrow as a condition of the stay.
