| DECISION & ORDER ON MOTION |
Separate motions by the appellants on appeals from a judgment of the Supreme Court, Dutchess County, dated July 12, 2006, and an order of the same court dated January 10, 2007, respectively, (1) to supplement the record to include certain documents and (2), in effect, to withdraw the appeal on behalf of James Kennedy and Marni Kennedy.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the motion to supplement the record is denied; and it is further,
ORDERED that the motion, in effect, to withdraw the appeal on behalf of James Kennedy and Marni Kennedy is granted, and the appeal is deemed withdrawn as to those appellants, without costs or disbursements.
