| DECISION & ORDER ON MOTION |
By decision and order of this court dated August 1, 1988, the respondent was suspended from the practice of law until the further order of this court and/or the determination of a disciplinary proceeding. By order of this court dated April 9, 1990, the Grievance Committee for the Second and Eleventh Judicial Districts was authorized to institute and prosecute a disciplinary proceeding against him. By opinion and order of this court dated September 16, 1991, pursuant to Judiciary Law * 90, the respondent was disbarred and his name stricken from the roll of attorneys and counselors-at-law, based upon his default. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the First Judicial Department on February 22, 1977, under the name Norman Julian Gersman.
Upon the papers filed in support of the motion and the papers filed and in response thereto, it is
ORDERED that the motion is denied.
We find that the respondent does not demonstrate the requisite fitness and character to practice law.
