It is Ordered that the motion is granted to the extent of enlarging the time to perfect the appeal to the November 2007 term and continuing the stay of the attorney's fee hearing. The papers submitted as a cross-motion, not having been timely served, were considered solely in opposition to the motion. [ see CPLR § 2215]. In the event the appellant fails to perfect the appeal by September 11, 2007, the respondent may move on five days' notice for an order vacating the stay.
