It is Ordered that the motion for a stay is granted on condition that the appellant: 1- on or before July 6, 2007, deposits $25,000.oo with the Clerk of the Civil Court, New York County; and 2- perfects the appeal by July 9, 2007, for the September 2007 term. Accruing use and occupancy, at the rate of $1,069.oo per month, is to be tendered to the petitioner, without prejudice, pending the determination of the appeal. In the event the appellant fails to comply with the order of this Court, the petitioner may move on five days' notice for an order vacating the stay.
