In the Matter of Yocheved D. (Anonymous).

Administration for Children's Services,

petitioner-respondent; Sally D, (Anonyomous),

appellant, et al., respondent.

(Docket No. N-26008/97)

ORDER TO SHOW CAUSE

Appeal by Sally D. from an order of the Family Court, Kings County, dated June 20, 2006. The notice of appeal was not filed until June 11, 2007, and the order on appeal scheduled a new permanency hearing for December 19, 2006.

Now, on the court's own motion, it is

ORDERED that the parties or their attorneys are directed to show cause before this court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding on the ground that the appeal was untimely taken (see Family Ct Act § 1113), or that the appeal has been rendered academic in light of the hearing scheduled for December 19, 2006, by each filing an affirmation or affidavit on that issue in the office of the Clerk of this court and serving one copy of the same on each other on or before July 13, 2007; and it is further,

ORDERED that the Clerk of this court, or his designee, is directed to serve a copy of this order to show cause upon the parties or their attorneys.

RIVERA, J.P., RITTER, FLORIO and FISHER, JJ., concur.
