Application by the appellant to withdraw the brief previously filed and for leave to serve and file a new brief on an appeal from a judgment of the Supreme Court, Westchester County, rendered June 2, 2005.
Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is
ORDERED that the application is granted, the brief previously filed by the appellant is deemed withdrawn, and on or before September 7, 2007, the appellant shall serve and file a new brief.
