DECISION

Motion by appellant to stay re-letting of the premises is granted on condition that within 10 days of the date of the order hereon, tenant deposit the sum of $45,000 in the form of certified checks or money orders in the court below; otherwise, motion denied. Tenant is directed to perfect the appeal by September 7, 2007.

In the event that tenant fails to perfect the appeal by the aforesaid date, the court on its own motion, may vacate the stay, or landlord-respondent may move to vacate the stay on three days' notice.
