| DECISION & ORDER ON MOTION |
Motion by the respondents to resettle a decision and order of this court dated May 1, 2007, which determined an appeal from a judgment of the Supreme Court, Westchester County, dated January 13, 2006, to delete the award of costs to the appellant.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and the decision and order dated May 1, 2007, is resettled by deleting from the decretal paragraph thereof the words "with costs to the appellant," and substituting therefor the words "without costs or disbursements."
