Motion by the respondent to dismiss an appeal from a judgment of the County Court, Suffolk County, rendered May 5, 2004, as abandoned.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied without prejudice to renew if, on or before August 15, 2007, the defendant fails to move for leave to prosecute the appeal as a poor person and for the assignment of counsel or to perfect the appeal.
