DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from an order of the Supreme Court, Nassau County, dated December 8, 2006, to impose sanctions on the respondent and her attorney, and for costs and an attorney's fee, pursuant to 22 NYCRR 670.4(b)(2), based upon the failure of the respondent and her attorney to appear at a scheduled CAMP conference.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that within 20 days of service upon it of a copy of this decision and order on motion, Richman & Levine, P.C., counsel for the respondent, is directed to pay a sanction in the sum of $500 to the Lawyers' Fund for Client Protection of the State of New York; and it is further,

ORDERED that within 20 days after service of a copy of this decision and order on motion upon her counsel the respondent shall deposit the sum of $500 with the Clerk of this court for transmittal to the Commissioner of Taxation and Finance (see 22 NYCRR 130-1.3); and it is further,

ORDERED that the Clerk of this court, or his designee, is directed to serve counsel for the parties with a copy of this decision and order on motion; and it is further,

ORDERED that within 10 days after payment of the sanction, Richman & Levine, P.C., shall file proof of payment with the Clerk of this court.
