The above named appellant having appealed to this court from a JUDGMENT OF CONVICTION of the CRIMINAL COURT, CITY OF NEW YORK, QUEENS COUNTY rendered on JUNE 1, 2004, and the RESPONDENT having moved this court by notice of motion returnable JUNE 1, 2007 to ENLARGE THE TIME TO FILE RESPONDENT'S BRIEF and said motion having duly come on to be heard;

Now, on reading the papers filed in support of said motion and no papers having been filed in opposition thereto, and due deliberation having been had thereon, it is,

ORDERED that the motion is granted, and said brief shall be served and filed by respondent within 21 days of the date of the order herein. Appellant, if he be so advised, may serve and file a reply brief within 14 days of the date that the respondent's brief is due to be filed pursuant to this order.
